Take data minimization. An employee pasting a client file into an AI prompt may seem harmless, but it could breach GDPR. These models don’t distinguish between sensitive and trivial data. Worse, if you’re using a free or consumer-grade version, there may be no data processing agreement in place—meaning your data could be used to train the model.
Transparency and control are equally critical. Most generative AI tools don’t make it obvious how input data is used, stored, or shared. Under GDPR, users and data subjects must be informed—and in many cases, given options to object or opt out. That’s difficult if you’re relying on tools that don’t support basic rights like access, correction, or erasure.
The regulatory picture is shifting, too. The upcoming EU AI Act, with its risk-based framework, will apply additional rules to high-impact AI use—especially in healthcare, HR, and financial services. Combined, GDPR and the AI Act create a dual compliance burden. And 2025 will be a turning point.

What’s the risk?
Not just fines. We’re talking about reputational damage, regulatory scrutiny, and loss of trust—especially if personal or confidential data leaks or AI outputs cause harm. The solution isn’t avoidance—it’s governance. That means enterprise-grade controls, clear policies, staff training, and working only with AI providers who support EU data protection standards.
